Il CBD \u00e8 legale in Europa?<\/h2>\n

Nella maggior parte dell’Europa, compresa la Spagna, i prodotti a base di CBD sono legali<\/a><\/strong>, ad eccezione della Slovacchia, dove il CBD rimane illegale. Vale la pena ricordare che uno dei fattori che hanno contribuito alla depenalizzazione del CBD in Europa \u00e8 stato ci\u00f2 che l’OMS ha detto sulle propriet\u00e0 terapeutiche e medicinali della cannabis.<\/p>\n

Inoltre, la Commission on Narcotic Drugs ha classificato i prodotti CBD sotto la sezione I della Convenzione unica sugli stupefacenti del 1961. Grazie a questo, l’Agenzia spagnola dei medicinali e dei prodotti sanitari<\/strong> ha stabilito che la fabbricazione, l’esportazione, l’importazione, la commercializzazione, il possesso e l’uso di prodotti CBD \u00e8 limitato esclusivamente a scopi medici e scientifici.<\/p>\n

\u00c8 anche possibile trasportare i prodotti CBD all’interno dell’Unione Europea. Tuttavia, la raccomandazione \u00e8 di comprare solo prodotti approvati con l’esatta percentuale di ingredienti attivi elencati sulla scatola, come avviene di solito.<\/p>\n

Per esempio, nel Regno Unito, la legislazione stabilisce che il trasporto e l’uso di cannabis con un contenuto di THC inferiore allo 0,2 per cento non richiede autorizzazione<\/strong>. Inoltre, nel caso di controllo e di studio, la percentuale del principio attivo<\/a> THC nelle piante pu\u00f2 essere considerata al di sotto di una sorta di “soglia di protezione”, che rimane inferiore allo 0,2% del principio attivo.<\/p>\n

\u00c8 anche importante sottolineare la sentenza della Corte di giustizia dell’Unione europea (CJEU) sulla depenalizzazione della CBD. Nella sentenza del 19 novembre 2020, la CGUE afferma che la commercializzazione dei prodotti CBD \u00e8 consentita nel territorio dell’Unione europea<\/strong>.<\/p>\n

Tornando alla questione delle percentuali, questa \u00e8 stata una delle principali condizioni perch\u00e9 il CBD sia legale in Europa. In altre parole, la Corte di giustizia europea ha stabilito che tutti i prodotti CBD devono contenere non pi\u00f9 dello 0,2% di THC<\/strong>.<\/p>\n

Questo \u00e8 molto importante perch\u00e9, come abbiamo detto in altre occasioni, questa percentuale di THC \u00e8 la quantit\u00e0 massima stabilita perch\u00e9 il CBD non sia considerato uno stupefacente.<\/p>\n
